บริษัท เอส แลนด์ 168 จำกัด (ต่อไปจะเรียกว่า “บริษัท” “เรา”, “พวกเรา” หรือ “ของเรา”) เป็นผู้ดำเนินการเว็บไซต์และ/หรือแอปพลิเคชัน SUWANBHUT (ซึ่งต่อไปจะเรียกรวมกันและแยกกันว่า “บริการ”) ขอบคุณที่ท่านให้ความสนใจใช้บริการของเรา เราให้ความสำคัญต่อความไว้วางใจของท่านในการแบ่งปันข้อมูลส่วนบุคคล (ตามที่นิยามไว้ในกฎหมายและระเบียบข้อบังคับว่าด้วยการคุ้มครองข้อมูลส่วนบุคคลที่บังคับใช้ในประเทศไทย ซึ่งรวมถึงพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 และกฎหมายและระเบียบข้อบังคับที่เกี่ยวข้อง (เรียกรวมกันว่า “กฎหมายคุ้มครองข้อมูลส่วนบุคคล”)) ของท่านให้กับเรา และเรามุ่งมั่นที่จะคุ้มครองความเป็นส่วนตัวของท่านตามที่อธิบายเพิ่มเติมในนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ (“นโยบายการคุ้มครองข้อมูลส่วนบุคคล”)

นโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้อธิบายว่า เราเก็บรวมรวม ใช้ โอน ประมวลผล หรือดำเนินการอื่นใด (เรียกรวมกันว่า “ประมวลผล”) ซึ่งข้อมูลส่วนบุคคลของท่านบนบริการของเราเมื่อใด อย่างไร และเพราะเหตุใด รวมถึงอธิบายสิทธิใด ๆ ที่ท่านอาจมีเกี่ยวกับข้อมูลส่วนบุคคลของท่านตามกฎหมายคุ้มครองข้อมูลส่วนบุคคล และวิธีการติดต่อเราเพื่อใช้สิทธิดังกล่าว กรุณาอ่านนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้โดยละเอียด เนื่องจากท่านมีความจำเป็นต้องเข้าใจว่า เราประมวลผลข้อมูลส่วนบุคคลของท่านอย่างไร และท่านสามารถควบคุมการประมวลผลข้อมูลส่วนบุคคลของท่านได้อย่างไร

ในการเข้าถึงหรือใช้บริการของเราหรือการให้ข้อมูลส่วนบุคคลของท่านกับเราโดยวิธีการอื่นใดก็ตามจะถือว่าท่านยอมรับว่า ท่านได้อ่านและทำความเข้าใจนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้แล้ว

1. ขอบเขตของนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้

นโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ใช้บังคับกับการประมวลผลข้อมูลส่วนบุคคลของท่านที่เกี่ยวข้องกับบริการของเรา ซึ่งรวมถึงแต่ไม่จำกัดเพียงข้อมูลส่วนบุคคลที่เราประมวลผลจาก (ก) การสมัครใช้ คำขอใช้ หรือการใช้บริการของเรา (ข) การติดต่อสื่อสารทางออนไลน์ของเรา (เช่น การโต้ตอบทางอีเมล หรือการสื่อสารผ่านช่องทางสื่อสังคมออนไลน์ของ SUWANBHUT ที่ผู้ให้บริการเครือข่ายสังคมออนไลน์ภายนอกเป็นเจ้าของและเป็นผู้ดำเนินการ) และการสื่อสารแบบออฟไลน์ (เช่น การสนทนาทางโทรศัพท์ โทรสาร หรือการสื่อสารแบบพบหน้า) ผ่านแบบสำรวจ แบบฟอร์ม จดหมาย เอกสาร หรือธุรกรรมทางธุรกิจ (ค) การปฏิสัมพันธ์ของท่านกับบริการของเราโดยวิธีการใด ๆ และ/หรือ (ง) ช่องทางหรือสถานที่อื่นใดที่เราควบคุมการประมวลผลข้อมูลส่วนบุคคล (เช่น การที่ท่านลงทะเบียนหรือการเข้าร่วมในงานกิจกรรม แคมเปญ การแข่งขันชิงรางวัล งานแถลงข่าว หรือกิจกรรมอื่น ๆ ที่เราจัดขึ้นและเป็นผู้ดำเนินการ) นโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ไม่เกี่ยวข้องกับข้อมูลในระดับภาพรวม (aggregated data) ข้อมูลนิรนาม (anonymized data) หรือข้อมูลที่ไม่สามารถระบุตัวบุคคลได้ หรือข้อมูลอื่นใดที่ไม่สามารถระบุถึงตัวตนของท่าน หรือไม่เกี่ยวข้องกับหรือตามหลักแล้วไม่อาจเชื่อมโยงถึงท่านได้

การให้และการใช้สินค้าหรือบริการอื่น ๆ ที่จัดให้มีบนบริการอาจอยู่ภายใต้บังคับของนโยบายการคุ้มครองข้อมูลส่วนบุคคลเพิ่มเติมเป็นการเฉพาะ ในกรณีที่ข้อกำหนดและเงื่อนไขของนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้และนโยบายการคุ้มครองข้อมูลส่วนบุคคลเพิ่มเติมโดยเฉพาะของสินค้าหรือบริการนั้นขัดแย้งกัน ให้บังคับใช้ตามนโยบายการคุ้มครองข้อมูลส่วนบุคคลเพิ่มเติมโดยเฉพาะของสินค้าหรือบริการนั้น

โปรดทราบว่า นโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ใช้บังคับกับบริการและ/หรือสินค้า บริการ หรือกิจกรรมใด ๆ ที่เราจัดให้มีบนบริการและ/หรือที่เราเป็นผู้ควบคุมและดำเนินการเท่านั้น และจะไม่มีผลใช้บังคับกับกิจกรรมและการปฏิสัมพันธ์ของท่านบนเว็บไซต์ แอปพลิเคชัน และ/หรือแพลตฟอร์มที่ดำเนินการโดยบุคคลภายนอกที่เชื่อมต่อกับบริการของเรา หรือที่ท่านถูกนำพาไปหรือเข้าถึงได้ผ่านบริการของเรา เราแนะนำให้ท่านอ่านและทำความเข้าใจนโยบายการคุ้มครองข้อมูลส่วนบุคคลของบุคคลภายนอกดังกล่าว

2. ข้อมูลส่วนบุคคลที่เราเก็บรวบรวม และวิธีการเก็บรวบรวมข้อมูลส่วนบุคคลของเรา

เราอาจประมวลผลข้อมูลส่วนบุคคลเกี่ยวกับท่านผ่านหรือบนบริการของเรา ทั้งนี้ ขึ้นอยู่กับความสัมพันธ์และปฏิสัมพันธ์ของท่านกับเรา

ข้อมูลส่วนบุคคลอาจถูกเก็บรวบรวมจากท่านโดยตรง หรือจากแหล่งข้อมูลอื่น ๆ เช่น หน่วยงานรัฐและหน่วยงานบังคับใช้กฎหมาย (เช่น สำนักงานป้องกันและปราบปรามการฟอกเงิน สำนักงานคณะกรรมการป้องกันและปราบปรามการทุจริตแห่งชาติ สำนักงานคณะกรรมการคุ้มครองผู้บริโภค สำนักงานตำรวจแห่งชาติ กรมบังคับคดี หรือหน่วยงานอื่น ๆ) เว็บไซต์สื่อสังคมออนไลน์ (ในกรณีที่ท่านใช้บัญชีสื่อสังคมออนไลน์ในการติดต่อเรา) แหล่งข้อมูลสาธารณะอื่น ๆ (เช่น ข่าวออนไลน์ บทความสาธารณะ หรือเว็บไซต์อื่น ๆ) หรือองค์กรของท่าน (ในกรณีที่ท่านเป็นผู้แทนหรือผู้ติดต่อขององค์กรของท่าน)

เราอาจเก็บรวบรวมข้อมูลส่วนบุคคล ซึ่งรวมถึงแต่ไม่จำกัดเพียงข้อมูลดังต่อไปนี้

  • ข้อมูลส่วนบุคคลทั่วไป – ชื่อ-นามสกุล ชื่อที่ประสงค์ให้เรียก (preferred name) คำนำหน้า อายุ วันเกิด สถานภาพสมรส ตำแหน่งงาน หน้าที่ความรับผิดชอบตามตำแหน่งงาน และชื่อองค์กรของท่าน
  • ข้อมูลติดต่อ – ที่อยู่ทางไปรษณีย์ ที่อยู่ที่พักอาศัย ที่อยู่ทางธุรกิจ ที่อยู่อีเมล ที่อยู่หรือที่ตั้งองค์กรของท่าน หมายเลขโทรศัพท์ หมายเลขโทรศัพท์มือถือ หมายเลขโทรสาร นามบัตร ชื่อผู้แทนหรือผู้ติดต่อขององค์กร ชื่อ/โปรไฟล์บัญชีสื่อสังคมออนไลน์ และรายละเอียดอื่น ๆ ที่ท่านแบ่งปันให้กับเรา
  • ข้อมูลพิสูจน์และยืนยันตัวตน – สำเนาเอกสารยืนยันตัวตน (เช่น บัตรประจำตัวประชาชน หรือหนังสือเดินทาง) เอกสารประจำตัวผู้เสียภาษี สำเนาทะเบียนบ้าน ลายมือชื่อ ข้อมูลส่วนบุคคลที่เกี่ยวข้องกับการอนุญาตให้ท่านใช้บริการและ/หรือติดต่อประสานงานกับเรา และข้อมูลส่วนบุคคลอื่น ๆ ที่ท่านแบ่งปันให้กับเราเพื่อวัตถุประสงค์ในการพิสูจน์หรือยืนยันตัวตน
  • ข้อมูลเกี่ยวกับธุรกรรมและข้อมูลทางการเงิน – ข้อมูลบัญชีธนาคารหรือข้อมูลทางการเงิน สำเนาสมุดบัญชีธนาคาร ข้อมูลหรือเอกสารที่อาจจำเป็นสำหรับการทำสัญญาหรือธุรกรรมระหว่างท่านกับเรา หรือเพื่อวัตถุประสงค์ในการแจ้งหนี้และชำระเงิน และข้อมูลอื่น ๆ ที่เกี่ยวข้องกับธุรกรรม (เช่น ข้อมูลการเรียกเก็บเงินและข้อมูลการจัดส่ง) หรือข้อมูลอื่น ๆ ที่เกี่ยวข้องกับสัญญาหรือธุรกรรมระหว่างท่านกับเราที่ท่านแบ่งปันให้กับเรา
  • ข้อมูลการติดต่อสื่อสาร – ข้อมูลหรือเอกสารใด ๆ ที่เราแลกเปลี่ยนกับท่าน รวมถึงแต่ไม่จำกัดเพียงข้อร้องเรียนและข้อเสนอแนะ/คำติชมของท่าน และคำขอหรือข้อซักถามของท่านเกี่ยวกับบริการของเราที่ส่งผ่านทางช่องทางการสนับสนุนลูกค้า (customer support portal) บัญชีสื่อสังคมออนไลน์ อีเมล จดหมาย โทรศัพท์ หรือช่องทางอื่น ๆ

  • ข้อมูลการปฏิสัมพันธ์ – ข้อมูลใด ๆ เกี่ยวกับการปฏิสัมพันธ์ของท่านกับเราหรือกับหน้าเว็บไซต์ของบุคคลภายนอกที่เกี่ยวข้องอื่น ๆ ที่แสดงบริการของเรา เช่น

    1. ข้อมูลส่วนบุคคลที่ท่านให้หรือแบ่งปันกับเราโดยสมัครใจเมื่อท่านเข้าร่วมกิจกรรมชิงรางวัล การแข่งขัน การประชุม สัมมนา การสำรวจ แคมเปญ งานกิจกรรม หรือกิจกรรมอื่นใดของเรา (รวมถึงการแข่งขัน การประชุม สัมมนา การสำรวจ แคมเปญ งานกิจกรรม หรือกิจกรรมใด ๆ ที่เราเป็นผู้การสนับสนุน)
    2. ภาพถ่าย และบันทึกเสียงและวิดีโอจากการมีส่วนร่วมหรือเข้าร่วมของท่านในกิจกรรมชิงรางวัล การแข่งขัน การประชุม สัมมนา การสำรวจ แคมเปญ งานกิจกรรม หรือกิจกรรมอื่นใดของเราเพื่อวัตถุประสงค์ในการประชาสัมพันธ์ การส่งเสริมการขาย และการตลาด
    3. ข้อมูลการใช้งาน: ข้อมูลส่วนบุคคลที่เกี่ยวข้องกับกิจกรรมบนบริการของเราและโฆษณาของเรา หน้าเว็บไซต์หรือโฆษณาที่ท่านดู คำสืบค้น บันทึกกิจกรรม (activity logs) และบันทึกวันที่/เวลาเกี่ยวกับการใช้งานของท่าน
    4. ข้อมูลอุปกรณ์: ข้อมูลส่วนบุคคล เช่น หมายเลขประจำเครื่องคอมพิวเตอร์ในระบบเครือข่ายหรือเลขที่อยู่ไอพี (IP address) หมายเลขประจำตัวของอุปกรณ์และแอปพลิเคชัน ข้อมูลตำแหน่งทางภูมิศาสตร์ ประวัติการท่องเว็บในเบราว์เซอร์ ผู้ให้บริการอินเทอร์เน็ตและ/หรือผู้ให้บริการเครือข่ายโทรศัพท์เคลื่อนที่ ระบบปฏิบัติการและข้อมูลการตั้งค่าระบบ การตั้งค่าตามความชอบส่วนบุคคล (preference setting) รหัสโฆษณา และข้อมูลอื่น ๆ ที่เกี่ยวข้องกับอุปกรณ์ที่เก็บรวบรวมโดยการใช้คุกกี้ และ
    5. ข้อมูลอื่น ๆ ที่เกี่ยวข้องกับการปฏิสัมพันธ์ของท่านกับบริการของเรา (โดยเฉพาะ เว็บไซต์ แอปพลิเคชัน และโฆษณาของเรา) ซึ่งท่านอนุญาตให้เราเก็บรวบรวมข้อมูลดังกล่าว
  • ข้อมูลส่วนบุคคลอื่น ๆ – ข้อมูลส่วนบุคคลใด ๆ ของท่านที่เราได้รับจากหน่วยงานรัฐ ศาล หรือหน่วยงานกำกับดูแล และข้อมูลส่วนบุคคลใด ๆ ที่ท่านให้กับเราโดยสมัครใจในรูปแบบใด ๆ และผ่านช่องทางใด ๆ (รวมถึงคำขอของท่านในฐานะเจ้าของข้อมูลส่วนบุคคล)

3. ข้อมูลส่วนบุคคลอ่อนไหว

โดยทั่วไป บริษัทไม่มีความประสงค์ที่จะเก็บรวบรวมข้อมูลส่วนบุคคลอ่อนไหว (Sensitive Personal Data) เช่น ข้อมูลเกี่ยวกับสุขภาพ ความพิการ เชื้อชาติหรือเผ่าพันธุ์ พฤติกรรมทางเพศ ความเชื่อทางศาสนา ข้อมูลพันธุกรรม ข้อมูลชีวภาพ หรือข้อมูลอื่นใดของท่านที่ถือเป็นข้อมูลส่วนบุคคลอ่อนไหวตามกฎหมายคุ้มครองข้อมูลส่วนบุคคล (เรียกรวมกันว่า “ข้อมูลส่วนบุคคลอ่อนไหว“)

อย่างไรก็ตาม หากมีความจำเป็นต้องประมวลผลข้อมูลส่วนบุคคลอ่อนไหวของท่าน บริษัทจะประมวลผลข้อมูลส่วนบุคคลอ่อนไหว เฉพาะในกรณีที่เราได้รับอนุญาตตามกฎหมายหรือในกรณีที่ท่านให้ความยินยอมกับเราเท่านั้น เราอาจขอให้ท่านปิดทับข้อมูลส่วนบุคคลอ่อนไหวดังกล่าวก่อนส่งเอกสารหรือข้อมูลที่มีข้อมูลส่วนบุคคลอ่อนไหวให้กับเรา หากท่านไม่ปฏิบัติตามคำแนะนำ บริษัทขอสงวนสิทธิในการปฏิบัติเสมือนว่าบริษัทไม่ได้เก็บรวบรวมข้อมูลส่วนบุคคลอ่อนไหวดังกล่าว

การอ้างอิงใด ๆ ถึงข้อมูลส่วนบุคคลภายใต้นโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้หมายรวมถึงข้อมูลส่วนบุคคลอ่อนไหวด้วย

4. ข้อมูลส่วนบุคคลของผู้เยาว์ คนไร้ความสามารถ และคนเสมือนไร้ความสามารถ

บริษัทไม่มีความประสงค์และไม่มีเจตนาดำเนินที่จะเก็บรวบรวมและประมวลผลข้อมูลส่วนบุคคลของผู้เยาว์ คนไร้ความสามารถ หรือคนเสมือนไร้ความสามารถ โดยไม่ได้รับความยินยอมจากผู้ใช้อำนาจปกครอง ผู้อนุบาล หรือผู้พิทักษ์ (แล้วแต่กรณี) หรือโดยไม่มีฐานทางกฎหมายอื่นที่กฎหมายอนุญาต

ทั้งนี้ เนื่องจากบริการของเราสามารถเข้าถึงได้โดยบุคคลทั่วไป หากท่านมีอายุต่ำกว่า 20 ปี หรือเป็นคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถ ท่านจะต้องได้รับคำแนะนำหรือได้รับความยินยอมจากผู้ปกครองหรือผู้ดูแลของท่านที่มีอำนาจในการกระทำการแทนท่าน ในการเข้าถึงและใช้บริการจะถือว่าท่านได้รับความยินยอมจากผู้ปกครองหรือผู้ดูแลของท่าน (แล้วแต่กรณี) โดยชอบแล้ว

หากเราพบว่า เราได้เก็บรวบรวมข้อมูลส่วนบุคคลจากผู้เยาว์โดยไม่ได้รับความยินยอมจากผู้ใช้อำนาจปกครอง (หากจำเป็นต้องได้รับความยินยอม) หรือเก็บรวบรวมข้อมูลส่วนบุคคลจากคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถโดยไม่ได้รับความยินยอมจากผู้ดูแล (หากจำเป็นต้องขอรับความยินยอม) โดยไม่เจตนา เราจะลบข้อมูลส่วนบุคคลดังกล่าวโดยเร็วที่สุด หรือประมวลผลข้อมูลส่วนบุคคลดังกล่าวเฉพาะตามที่กฎหมายอนุญาตเท่านั้น

5. ฐานทางกฎหมายในการประมวลผลข้อมูลส่วนบุคคล และเราใช้ข้อมูลส่วนบุคคลของท่านอย่างไร

เราประมวลผลข้อมูลส่วนบุคคลของท่านตามกฎหมายคุ้มครองข้อมูลส่วนบุคคล และเราอาจประมวลผลข้อมูลส่วนบุคคลของท่านโดยอาศัยฐานทางกฎหมายดังต่อไปนี้ (ก) ความยินยอมของท่าน (ข) ฐานสัญญา เพื่อการริเริ่มเข้าทำ ดำเนินการ ปฏิบัติตามสัญญาระหว่างเรากับท่านเพื่อการให้บริการของเรา หรือตามที่ท่านร้องขอก่อนที่จะเข้าทำสัญญากับเรา (ค) ฐานหน้าที่ตามกฎหมาย เพื่อการปฏิบัติตามภาระหน้าที่ตามกฎหมายของเรา (ง) ฐานประโยชน์โดยชอบด้วยกฎหมาย เพื่อประโยชน์โดยชอบด้วยกฎหมายของเราและของผู้อื่น โดยที่เราจะประมวลผลข้อมูลส่วนบุคคลโดยคำนึงถึงประโยชน์ของท่าน รวมถึงสิทธิและเสรีภาพขั้นพื้นฐานที่ท่านมีในการคุ้มครองข้อมูลส่วนบุคคลของท่าน (จ) ฐานประโยชน์สำคัญต่อชีวิต ตามที่จำเป็นในการปกป้องชีวิต ร่างกาย หรือสุขภาพของบุคคลใด ๆ (ตามที่นิยามไว้ในกฎหมายคุ้มครองข้อมูลส่วนบุคคล) (ฉ) ฐานประโยชน์สาธารณะ เพื่อการปฏิบัติงานใด ๆ เพื่อประโยชน์สาธารณะ หรือการใช้อำนาจหรือหน้าที่ของหน่วยงานรัฐ และ/หรือ (ช) เพื่อวัตถุประสงค์ในการก่อตั้ง ปฏิบัติตาม ใช้ หรือยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย

เราอาจประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ต่าง ๆ ซึ่งรวมถึง

  • เพื่อเสนอและให้บริการของเราแก่ท่าน
  • เพื่อสนับสนุนและอำนวยความสะดวกแก่ท่านในการใช้บริการของเรา
  • เพื่อตอบสนองต่อคำขอของท่านเกี่ยวกับการดำเนินการ การสนับสนุน หรือข้อมูล และเพื่อบริหารจัดการและอำนวยความสะดวกแก่เราในการต่อต่อสื่อสารหรือให้การสนับสนุนบริการแก่ท่าน
  • เพื่อพิสูจน์ตัวตนและการได้รับอนุญาตของท่าน และ/หรือเพื่อพิจารณาคุณสมบัติของท่านในการรับบริการของเราหรือในการเข้าร่วมกิจกรรมที่เกี่ยวข้องกับบริการตามที่ท่านร้องขอ
  • เพื่อรักษา จัดการ พัฒนา และเพิ่มความปลอดภัย ความถูกต้องสมบูรณ์ และความมีประสิทธิผลของบริการและระบบที่เกี่ยวข้องอื่น ๆ (เช่น การตรวจจับและตรวจสอบการฉ้อโกง) และเพื่อให้มั่นใจว่ามีการปฏิบัติตามข้อกำหนดและนโยบายของเราเกี่ยวกับการแก้ไขปัญหาการใช้งาน การติดตามตรวจสอบกิจกรรมที่น่าสงสัยหรือผิดกฎหมาย การป้องกันการเข้าถึงหรือการใช้บริการโดยไม่ได้รับอนุญาต การให้การสนับสนุนด้านเทคนิค (เช่น การปรับปรุงบริการ การแก้ไขข้อบกพร่อง (bug fix) หรือการแก้ไขปัญหาการใช้งานอื่น ๆ) การจัดเก็บข้อมูล และการสำรองข้อมูล
  • เพื่อการทำความเข้าใจให้ดียิ่งขึ้นเกี่ยวกับการเข้าถึงและการใช้บริการของเราโดยบุคคลทั่วไป เพื่อตรวจสอบ ปรับปรุงให้ดียิ่งขึ้น และปรับปรุงเปลี่ยนแปลงบริการของเรา เพื่อพัฒนาบริการใหม่ ๆ และเพื่อเสนอบริการ ข้อเสนอ หรือกิจกรรมส่งเสริมทางการตลาดที่เหมาะสมกับความต้องการของท่านโดยเฉพาะให้กับท่าน
  • เพื่อเข้าทำสัญญาหรือทำธุรกรรมกับท่าน หรือเพื่อปฏิบัติตามภาระหน้าที่ตามสัญญาระหว่างบริษัทกับท่าน (หรือองค์กรของท่าน) หรือระหว่างบริษัทกับบุคคลภายนอกใด ๆ
  • เพื่อจัดการ พัฒนา หรือบริหารความสัมพันธ์ทางธุรกิจของเรา (รวมถึงเพื่อวัตถุประสงค์ในการเรียกเก็บเงินและการจัดการบัญชี)
  • เพื่อบริหาร อำนวยความสะดวก และจัดการการลงทะเบียนและการมีส่วนร่วมของท่าน และเพื่อให้ท่านสามารถลงทะเบียนหรือเข้าร่วมกิจกรรมส่งเสริมทางการตลาด การแข่งขัน การสำรวจ แคมเปญ งานกิจกรรม และกิจกรรมอื่น ๆ ได้
  • ในกรณีที่ท่านเลือก เพื่อให้ข้อมูลการตลาดและการส่งเสริมการขายที่เกี่ยวข้อง และเพื่อนำเสนอโฆษณาหรือข้อเสนอเกี่ยวกับบริการของเรา และ/หรือผลิตภัณฑ์ บริการ และเนื้อหาของบริษัทในเครือ และพันธมิตรทางธุรกิจของเราที่เหมาะสมกับความต้องการของท่านให้แก่ท่าน
  • เพื่อปรับปรุงประสิทธิภาพของโฆษณา กิจกรรมการตลาด และกิจกรรมส่งเสริมการขายที่แสดงบนหรือที่เกี่ยวข้องกับบริการของเรา
  • เพื่อวิเคราะห์ข้อมูลการใช้งานของท่านเพื่อวัตถุประสงค์ในการติดตามแนวโน้มการใช้งานและส่งมอบบริการหรือบริการใหม่ ๆ ให้กับท่าน หรือการนำเสนอโฆษณาหรือเนื้อหาส่งเสริมการขายและการตลาดที่เกี่ยวข้องและตรงกับความสนใจของท่านมากยิ่งขึ้น
  • เพื่อบริหารจัดการธุรกิจของเราและปกป้องผลประโยชน์ของเรา รวมทั้งรักษาความมั่นคงปลอดภัยและความถูกต้องสมบูรณ์ของธุรกิจของเรา เพื่อใช้สิทธิของเราหรือปกป้องผลประโยชน์ของเราในกรณีที่จำเป็นและชอบด้วยกฎหมาย (เช่น เพื่อบริหารจัดการ ตรวจสอบ หรือประเมินความเสี่ยง) เพื่อจัดการและป้องกันการสูญเสียสินทรัพย์และทรัพย์สินของเรา เพื่อให้มั่นใจว่ามีการปฏิบัติตามข้อกำหนดในการให้บริการของเรา เพื่อตรวจจับและป้องกันการประพฤติมิชอบ เพื่อป้องกันและรายงานความผิดทางอาญา และเพื่อบริหารจัดการภายในธุรกิจ
  • เพื่อปฏิบัติตามภาระหน้าที่ตามกฎหมาย รวมถึงการดำเนินการทางกฎหมาย หรือคำสั่งของหน่วยงานรัฐ เมื่อเรามีเหตุผลอันสมควรเชื่อว่ากฎหมายกำหนดให้เราต้องดำเนินการดังกล่าว
  • เพื่อวัตถุประสงค์ในการทำธุรกรรมองค์กร ในกรณีที่มีการขาย การโอน การควบรวมกิจการ การปรับโครงสร้างองค์กร หรือกรณีอื่นใดที่คล้ายกัน เราอาจโอนข้อมูลส่วนบุคคลของท่านไปยังบุคคลภายนอกรายหนึ่งรายใดหรือมากกว่าอันเป็นส่วนหนึ่งของกระบวนการทำธุรกรรมดังกล่าว หรือเพื่อการตรวจสอบ การวิเคราะห์ และการรายงานระดับองค์กร
  • เพื่อปกป้องชีวิต ร่างกาย หรือสุขภาพของบุคคลใด ๆ และ
  • เพื่อวัตถุประสงค์อื่น ๆ ที่ท่านให้ความยินยอมแก่เราเป็นการเฉพาะ หรือที่เราได้รับอนุญาตให้ประมวลผลข้อมูลส่วนบุคคลของท่านภายใต้กฎหมายที่บังคับใช้

เราอาจไม่สามารถให้บริการบางส่วนแก่ท่านได้หากท่านไม่ให้ข้อมูลส่วนบุคคลบางอย่างแก่เรา ยกตัวอย่างเช่น เราอาจไม่สามารถประมวลผลคำขอของท่าน หรือไม่สามารถปฏิบัติตามภาระหน้าที่ของเราภายใต้สัญญาที่ท่านมีกับเรา หรือไม่สามารถปฏิบัติตามภาระหน้าที่ตามกฎหมายตามที่กำหนดไว้ได้

7. การเปิดเผยข้อมูลส่วนบุคคลต่อบุคคลภายนอก

  • พันธมิตรทางธุรกิจ (เช่น พันธมิตรทางการตลาด/โฆษณาภายนอก) – หากท่านตกลงที่จะเข้าร่วมกิจกรรม งานอีเวนต์ หรือแคมเปญใด ๆ ทางการตลาด การส่งเสริมการขาย หรือการโฆษณาที่เกี่ยวข้องกับบริการของเรา เราอาจเปิดเผยข้อมูลส่วนบุคคลของท่านต่อพันธมิตรทางธุรกิจที่เกี่ยวข้องของเราเพื่อประมวลผลหรือจัดการการเข้าร่วมในกิจกรรม งานอีเวนต์ หรือแคมเปญดังกล่าวของท่าน ในกรณีนี้ พันธมิตรของเราจะประมวลผลและควบคุมข้อมูลส่วนบุคคลของท่าน และข้อมูลส่วนบุคคลดังกล่าวจะตกอยู่ใต้บังคับของนโยบายการคุ้มครองข้อมูลส่วนบุคคลของพันธมิตรดังกล่าว
  • สถาบันการเงิน – เราอาจเปิดเผยข้อมูลส่วนบุคคลต่อสถาบันการเงินที่เกี่ยวข้องเพื่อวัตถุประสงค์ในการแจ้งหนี้และชำระเงิน อำนวยความสะดวกในการทำธุรกรรมระหว่างเรากับท่าน และจัดการการฉ้อโกงและความเสี่ยง
  • บุคคลอื่นที่เกี่ยวข้องกับธุรกรรมขององค์กร – ในขอบเขตที่กฎหมายอนุญาต เราอาจเปิดเผยข้อมูลส่วนบุคคลที่เกี่ยวข้องกับหรือในระหว่างการเจรจาการควบรวมกิจการ การเข้าซื้อกิจการ การขายสินทรัพย์ของบริษัทหรือการโอนธุรกิจทั้งหมดหรือบางส่วนของเราไปยังบริษัทอื่น และ

8. การโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ

บริการของเราดำเนินการในประเทศไทย เราอาจโอนข้อมูลส่วนบุคคลของท่านไปยังต่างประเทศตามที่จำเป็นเพื่อวัตถุประสงค์ที่อธิบายไว้ข้างต้น หากท่านไม่ได้อาศัยอยู่ในประเทศไทย ข้อมูลส่วนบุคคลของท่านจะถูกโอนไปยังและจัดการในประเทศไทย ซึ่งเป็นที่ตั้งของเซิร์ฟเวอร์ของเรา เพื่อการให้บริการแก่ท่านและ/หรือเพื่อดำเนินธุรกรรมใด ๆ ที่ร้องขอ ท่านรับทราบว่า กฎหมายคุ้มครองข้อมูลส่วนบุคคลและกฎหมายที่บังคับใช้อื่น ๆ ของเขตพื้นที่อื่น (เช่น ประเทศไทย) อาจไม่มีกฎหมายคุ้มครองข้อมูลส่วนบุคคลเช่นเดียวกับในเขตพื้นที่ของท่าน

เราอาจดำเนินงานร่วมกับบริษัทในกลุ่มของเราหรือผู้ให้บริการและพันธมิตรภายนอกในเขตพื้นที่อื่น ๆ ในการให้บริการเป็นครั้งคราว นั่นหมายความว่า เราอาจจำเป็นต้องเปิดเผย โอน หรือประมวลผลข้อมูลส่วนบุคคลของท่านโดยวิธีการอื่นใดภายนอกประเทศไทย เพื่อดำเนินการตามวัตถุประสงค์ในการให้บริการแก่ท่าน เมื่อเราโอนข้อมูลส่วนบุคคลของท่านไปยังผู้รับข้อมูลในเขตพื้นที่อื่น ๆ เราจะคุ้มครองข้อมูลส่วนบุคคลตามที่อธิบายไว้ในนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ และจะดำเนินการให้มั่นใจว่าข้อมูลส่วนบุคคลที่มีการเปิดเผย หรือโอน หรือประมวลผลโดยวิธีการอื่นใดนั้นได้รับการคุ้มครองตามมาตรการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอเหมาะสมตามมาตรฐานสากล ทั้งนี้ หากจำเป็น เราอาจขอความยินยอมจากท่านในกรณีที่กฎหมายที่บังคับใช้กำหนดให้ต้องได้รับความยินยอมในการโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ

9. การรักษาความมั่นคงปลอดภัยของข้อมูล

บริษัทมุ่งมั่นที่จะคงไว้ซึ่งมาตรการรักษาความมั่นคงปลอดภัยที่เหมาะสม ทั้งในเชิงเทคนิค เชิงองค์กร และเชิงการบริหารจัดการ เพื่อคุ้มครองความปลอดภัย การรักษาความลับ และความถูกต้องสมบูรณ์ของข้อมูลส่วนบุคคล อีกทั้งเรายังจัดให้มีซึ่งนโยบายการรักษาความปลอดภัยและการเข้าถึงข้อมูลเพื่อจำกัดการเข้าถึงระบบและเทคโนโลยีของเรา อย่างไรก็ตาม โปรดทราบว่า ระบบเครือข่ายอินเทอร์เน็ตและเทคโนโลยีสารสนเทศนั้นมีความเสี่ยงด้านความมั่นคงปลอดภัยอยู่เสมอ เราจึงไม่อาจรับประกันได้ว่า ข้อมูลใด ๆ (รวมถึงข้อมูลส่วนบุคคล) จะปลอดภัยจากการบุกรุกจากภายนอกอย่างสมบูรณ์ในระหว่างการส่งหรือจัดเก็บในระบบของเรา

10. การเก็บรักษาข้อมูล

เราจะเก็บรักษาข้อมูลส่วนบุคคลของท่าน (ก) ตลอดระยะเวลาที่ท่านมีความสัมพันธ์กับเรา และ/หรือ (ข) ตราบเท่าที่จำเป็นในการดำเนินการตามวัตถุประสงค์ที่อธิบายไว้ข้างต้น และ/หรือ (ค) เพื่อปฏิบัติตามข้อกำหนดทางกฎหมายที่บังคับใช้ ทั้งนี้ เมื่อไม่มีความจำเป็นต้องประมวลผลข้อมูลส่วนบุคคลของท่านอีกต่อไป เราจะลบหรือทำให้ข้อมูลส่วนบุคคลของท่านกลายเป็นข้อมูลที่ไม่สามารถระบุตัวตนของท่านได้ โปรดทราบว่า เราอาจขยายระยะเวลาการเก็บรักษาข้อมูลส่วนบุคคลออกไป หากเราจำเป็นต้องเก็บรักษาข้อมูลส่วนบุคคลของท่านที่เกี่ยวข้องกับการดำเนินการทางกฎหมายใด ๆ หรือหากกฎหมายที่บังคับใช้กำหนดหรืออนุญาตให้สามารถเก็บรักษาข้อมูลส่วนบุคคลนานกว่านั้นได้

11. สิทธิของท่าน

ภายใต้บทบัญญัติของกฎหมายคุ้มครองข้อมูลส่วนบุคคล ท่านอาจมีสิทธิหลายประการเกี่ยวกับการประมวลผลข้อมูลส่วนบุคคลของท่าน ซึ่งรวมถึง

  1. สิทธิในการขอเข้าถึงข้อมูล: ท่านมีสิทธิในการเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่าน หรือร้องขอให้เปิดเผยการได้มาซึ่งข้อมูลส่วนบุคคลโดยไม่ได้รับความยินยอมจากท่าน (เรามีสิทธิเรียกเก็บค่าดำเนินการตามคำขอดังกล่าวได้ตามสมควร หากได้รับอนุญาตตามกฎหมายคุ้มครองข้อมูลส่วนบุคคล)
  2. สิทธิในการแก้ไขข้อมูล: ท่านมีสิทธิร้องขอให้แก้ไขข้อมูลส่วนบุคคลของท่านให้ถูกต้อง เป็นปัจจุบัน ครบถ้วน และไม่ก่อให้เกิดความเข้าใจผิด
  3. สิทธิในการขอลบข้อมูล: ท่านสามารถขอให้เราลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านกลายเป็นข้อมูลที่ไม่สามารถระบุตัวตนของท่านได้ หากข้อมูลนั้นไม่มีความจำเป็นสำหรับวัตถุประสงค์ที่กำหนดไว้ในนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้อีกต่อไป หรือไม่มีฐานทางกฎหมายในการประมวลผลอีกต่อไป
  4. สิทธิในการขอคัดค้าน: ท่านสามารถคัดค้านการใช้ข้อมูลส่วนบุคคลของท่านในการทำการตลาดทางตรง (รวมถึงการทำโปรไฟลิ่ง) หรือคัดค้านการประมวลผลอื่น ๆ บนฐานประโยชน์โดยชอบด้วยกฎหมายได้
  5. สิทธิในการขอโอนย้ายข้อมูล: ในบางกรณี ท่านสามารถร้องขอให้เราส่งสำเนาข้อมูลส่วนบุคคลของท่านในรูปแบบใด ๆ ที่สามารถหรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติ อีกทั้งยังมีสิทธิร้องขอให้ส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคล (ตามที่นิยามไว้ในกฎหมายคุ้มครองข้อมูลส่วนบุคคล) รายอื่นโดยวิธีการอัตโนมัติ และมีสิทธิในการขอรับข้อมูลส่วนบุคคลที่ส่งหรือโอนไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่นโดยตรง เว้นแต่จะไม่สามารถทำได้ในทางเทคนิค
  6. สิทธิในการขอระงับการใช้ข้อมูลส่วนบุคคล: ท่านสามารถร้องขอให้เราใช้ข้อมูลส่วนบุคคลของท่านอย่างจำกัดได้ในบางสถานการณ์
  7. สิทธิในการขอเพิกถอนความยินยอม: ท่านมีสิทธิที่จะเพิกถอนความยินยอมที่ท่านเคยให้ไว้สำหรับการประมวลผลข้อมูลส่วนบุคคลของท่านเมื่อใดก็ได้ โดยการเพิกถอนความยินยอมสามารถกระทำได้โดยการติดต่อไปยังรายละเอียดการติดต่อที่ระบุไว้ในนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ โปรดทราบว่า การเพิกถอนความยินยอมจะไม่กระทบต่อความชอบด้วยกฎหมายของการประมวลผลข้อมูลส่วนบุคคลและข้อมูลส่วนบุคคลอ่อนไหวของท่านตามที่ได้รับความยินยอมจากท่านก่อนที่จะเพิกถอนความยินยอม ทั้งนี้ หากท่านไม่ให้ความยินยอมหรือเพิกถอนความยินยอมของท่าน เราอาจไม่สามารถให้บริการบางส่วนหรือทั้งหมดแก่ท่านได้
  8. สิทธิในการยื่นเรื่องร้องเรียน: ท่านสามารถยื่นเรื่องร้องเรียนต่อหน่วยงานคุ้มครองข้อมูลส่วนบุคคลหรือหน่วยงานที่มีอำนาจ หากท่านเชื่อว่าเราประมวลผลข้อมูลส่วนบุคคลของท่านโดยไม่ชอบด้วยกฎหมายหรือไม่เป็นไปตามกฎหมายคุ้มครองข้อมูลส่วนบุคคล อย่างไรก็ดี เราขอขอบคุณ หากท่านให้โอกาสเราได้แก้ไขข้อกังวลของท่านก่อนที่ท่านจะติดต่อหน่วยงานใด ๆ ดังกล่าว ดังนั้น โปรดติดต่อเราก่อนยื่นเรื่องร้องเรียน

คำขอใช้สิทธิใด ๆ ของท่านข้างต้นอาจถูกจำกัดโดยกฎหมายที่บังคับใช้ และอาจมีบางกรณีที่มีเหตุให้เราสามารถปฏิเสธคำขอของท่านได้โดยชอบด้วยกฎหมาย เช่น เนื่องด้วยภาระหน้าที่ตามกฎหมายของเรา หรือคำสั่งศาล

ทั้งนี้ หากจำเป็น ก่อนที่จะดำเนินการตามคำขอของท่าน เราอาจขอให้ท่านยืนยันตัวตนและให้ข้อมูลส่วนบุคคลแก่เราตามที่จำเป็นเพื่อทำความเข้าใจคำขอของท่านให้ดียิ่งขึ้น

12. การเปลี่ยนแปลงนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้

13. ภาษา

Image Future (Thailand) Limited (hereinafter referred to as “Company“, “we“, “us“, or “our“), which operates Suwanbhut’s website(s) and/or application(s) (individually and collectively, the “Services“), appreciates your interest in using our Services. We value your trust in sharing with us your Personal Data (as defined in the applicable data protection laws and regulations in Thailand, including the Personal Data Protection Act B.E. 2562 (2019) and its related laws and regulations (collectively, the “Data Protection Laws“)) and are committed to protecting your privacy, as further described in this privacy policy (“Privacy Policy“).

This Privacy Policy explains when, how, and why we collect, use, transfer, process, or otherwise conduct any other operations (collectively, “Process“, “Processing” or “Processed“) of your Personal Data on our Services, any rights you may have with respect to your Personal Data in accordance with the Data Protection Laws, and how to contact us for exercising any of those rights. Please read this Privacy Policy carefully as it is necessary for you to understand how we Process your Personal Data and how you can control it.

1. Scope of this Privacy Policy

This Privacy Policy governs our Processing of your Personal Data in connection with our Services, including but not limited to the Personal Data we Process from: (a) your application for the use, request for the use, or use of our Services; (b) our online communications (e.g., email correspondence or communications through Suwanbhut’s social media channels owned and operated by third-party social networking service providers) and offline communications (e.g., phone conversations, faxes, or face-to-face communication) through surveys, forms, letters, documents, business transactions; (c) your interactions with our Services by any means; and/or (d) any other channels or locations where we control the Processing of the Personal Data (such as your enrolment or participation of our events, campaigns, contests, press conference, or other activities held and organized by us). This Privacy Policy does not relate to aggregated, anonymized, or de-identified data or any other information that does not allow us to identify you or is not capable of being associated with or reasonably linked to you.

The provision and use of other goods or services provided on the Services may be subject to specific additional privacy policies. In the event of conflicting terms between this Privacy Policy and the additional privacy policies of specific goods or services, the additional privacy policies of specific goods or services shall prevail.

Please note that this Privacy Policy is applicable to the Services and/or any goods, services, or activities provided on the Services and/or controlled and operated by us only and is not applicable to your activities and interactions on website(s), application(s), and/or platform(s) operated by third parties which may be linked from or directed from or accessed through our Services. 2. Personal Data We Collect and How We Collect Personal Data

Through or on our Services, we may Process Personal Data about you based on your relationship and interactions with us.

The Personal Data may be collected directly from you or from other sources, such as governmental authorities and law enforcement agencies (such as the Anti-Money Laundering Office, the Office of the National Anti-Corruption Commission of Thailand, the Office of the Consumer Board of Protection, Royal Thai Police, Legal Execution Department, or other authorities), social media sites (if you use your social media account to contact us), other publicly available sources (such as online news, publicly available articles, or other websites), or your organization (if you are a representative or contact of your organization).

The Personal Data that we may collect includes, but is not limited to:

  • General Personal Data – Full name, preferred name, prefix, age, date of birth, marital status, job title, job responsibilities, and name of your organization.
  • Contact information – Mailing address, residential address, business address, email address, address or location of your organization, telephone number, mobile phone numbers, fax number, business card, name of representative or contact of the organization, social media account names/profiles, and other contact details you share with us.
  • Identification and verification information – A copy of identification documents (such as ID card or passport), tax identification documents, a copy of house registration, signatures, Personal Data relating to your authorization to use the Services and/or liaise with us, and other Personal Data you share with us for the purposes of identification or verification.
  • Transaction and financial information – Bank account or financial information, a copy of passbook, information or documents which may be required for the agreement or transaction between you and us or for the purposes of invoicing and payment, and other information relating to the transaction (such as billing and shipping information) or you share with us in connection with the transaction or agreement between you and us.
  • Communications information – Any information or documents that we exchange with you, including but not limited to your complaints and feedback, and your request or inquiry about our Services, through our customer support portal, social media accounts, email, letters, phone, or otherwise.

  • Interaction information – Any information about your interactions with us or with other relevant third-party pages displaying our Services, such as:

    • Personal Data you furnish to or share with us when you participate in our reward programs, contests, meetings, seminars, surveys, campaigns, events, or any other activities (including our sponsored contests, meetings, seminars, surveys, campaigns, events, or activities) on a voluntary basis;
    • Photographs and audio and video recordings of your participation in or attendance at our reward programs, contests, meetings, seminars, surveys, campaigns, events, or any other activities for public relations, promotional, and marketing purposes;
    • Usage Data: Personal Data relating to activities on our Services and our advertisements, the pages or advertisements you viewed, searches, activity log records, and date/time stamps associated with your usage.
    • Device Data: Personal Data such as IP address, device and application identification numbers, geolocation information, browsing history, internet service provider and/or mobile carrier, operating system and system configuration information, preference settings, advertising ID, and other device-related information collected using Cookies; and
    • Other information relating to your interactions with our Services (in particular, our websites, applications, and advertisements) which you allow us to collect it.
  • Other Personal Data – Any of your Personal Data that we receive from governmental authorities, courts, or regulatory bodies, and any Personal Data you voluntarily provide to us in any formats and on any channels (including your data subject requests).

3. Sensitive Personal Data

Generally, the Company does not intend to collect sensitive Personal Data, such as information relating to your health, disabilities, ethnicity, sexual behavior, religious belief, genetic data, biometric data, or other data that is regarded as sensitive Personal Data under the Data Protection Laws (collectively, the “Sensitive Personal Data“)

However, if there is a necessity for the Company to Process your Sensitive Personal Data, we will Process the Sensitive Personal Data where we are permitted to do so by law or where you give us your consent only.

We may ask you to redact such Sensitive Personal Data before submitting the documents or information containing the Sensitive Personal Data to us. If you do not do as advised, the Company reserves the right to treat the situation as if the Company has not collected such Sensitive Personal Data.

Any reference to the Personal Data under this Privacy Policy shall include the Sensitive Personal Data.

4. Personal Data of Minors, Incompetent Persons and Quasi-Incompetent Persons

The Company does not intend to and does not knowingly collect and Process the Personal Data of minors, incompetent persons, or quasi-incompetent persons without the consent of the persons exercising parental power, curators, or guardians (as applicable) or without other legal basis permitted by law.

However, as our Services are generally accessible by all individuals, if you are under the age of 20 or incompetent or quasi-incompetent, you must be advised by or have the consent of your parent or guardian who has the authority to act on your behalf. By using and accessing the Services, it would be deemed that the consent from your parent or guardian (as applicable) is duly obtained.

If we learn that we have unintentionally collected the Personal Data from any minors without the consent of the persons exercising parental power when it is required or from incompetent persons or quasi-incompetent persons without their guardian’s consent when it is required, we will delete such Personal Data in a timely manner or Process such Personal Data only if we are permitted to do so by law.

5. Legal Bases for Processing of Personal Data and How We Use Your Personal Data

We Process your Personal Data in accordance with the Data Protection Laws, and we may Process your Personal Data by relying on the following legal bases: (a) your consent; (b) contractual basis for initiation, performance, and fulfilment of our contract with you to provide our Services or as requested by you prior to entering into a contract with us; (c) legal obligation basis for our fulfilment of our legal obligations; (d) legitimate interest basis for our and other parties’ legitimate interest, which our Processing of Personal Data will be proportionate to your interest, fundamental rights and freedoms, to protect your Personal Data; (e) vital interest basis as necessary to protect a Person’s (as defined in the Data Protection Laws) life, body, or health; (f) public interest basis for the performance of a task carried out in the public interest or exercising official authorities or duties; and/or (g) for the purpose of the establishment, compliance, exercise or defense of legal claims.

We may Process your Personal Data for several purposes, including:

  • To provide and offer our Services to you;
  • To support and facilitate your use of our Services;
  • To respond to your requests for actions, support, or information; and to administer and facilitate our communications or service support to you;
  • To verify your identity and authorization and/or to determine your eligibility for our Services or Service-related activities requested by you;

  • To analyze your usage information for the purposes of trend monitoring and providing you with the Services or new services, or advertisements or promotional and marketing content that are more relevant to you and your interests;
  • To manage our business and protect our interests, including to protect the security and integrity of our business; to exercise our rights or protect our interest where it is necessary and lawful to do so, (e.g., to perform risk management, audit or assessments); to manage and prevent loss of our assets and property; to secure the compliance of our Terms of Services; to detect and prevent misconduct; to prevent and report criminal offences and to manage internal business;
  • To comply with legal obligations, including legal proceedings, or government authorities’ orders when we reasonably believe we are legally required to do so;
  • For the purpose of corporate transactions, in the event of a sale, transfer, merger, reorganization, or similar event, we may transfer your Personal Data to one or more third parties as part of that transaction; for corporate audit, analysis, and reporting;
  • To protect a Person’s life, body, or health; and
  • For other purposes for which you specifically give us consent to or for which we are authorized to Process your Personal Data under the applicable laws.

We may not be able to perform certain Services if you fail to provide certain Personal Data. For example, we may not be able to process your request, we may not be able to comply with our obligations under the contract you have with us, or we may not be able to comply with legal obligations as required.

The Company has the right to Process your Personal Data collected by the Company prior to the effective date of the Data Protection Laws for the original purposes for which it was collected. If you do not want the Company to continue to Process such Personal Data, you can inform the Company to opt out at any time.

7. Disclosure of Personal Data to Third Parties

We generally do not disclose or share your Personal Data with third parties unless we obtain your consent to do so or as permitted by law or as required in accordance with the purposes of how we use it as mentioned above. In particular, we may disclose the Personal Data to the following types of third parties for the following purposes:

  • Our affiliates – We may disclose the Personal Data to our affiliates and/or group companies in the case where it is necessary for the purposes of Processing of Personal Data specified under this Privacy Policy and our general business purposes, including but not limited to providing our Services to you, administering our relationship with you, providing customer or technical supports, and fulfilling of your request regarding the Services;
  • Vendors/service providers – We may disclose the Personal Data to third party vendors and service providers for general business purposes and to support our internal operations and/or the Services, including but not limited to cloud or data center service providers, IT solutions service providers, marketing or advertising service providers, consultants, professional advisers, public relations service providers, social media service providers, customer service providers, courier service providers, mailing and email service providers, communication service providers, data enhancement service providers, and analytics service providers;
  • Business partners (such as third-party marketing/advertising partners) – If you agree to participate in any marketing, promotional, or advertising activities, events, or campaigns in connection with our Services, we may disclose your Personal Data to our relevant business partners to Process or manage your participation in the activities, events, or campaigns. In this case, our partners will Process and have control over your Personal Data, and such Personal Data will be governed by their privacy policies;
  • Financial institutions – We may disclose the Personal Data to the relevant financial institutions for the purposes of invoicing and payments, facilitating our transactions with you, and managing fraud and risk;
  • Corporate transaction-related persons – To the extent permitted by law, we may disclose the Personal Data in connection with, or during negotiations of, any merger, acquisition, sale of Company assets, or transition of all or a portion of our business to another company; and
  • Law enforcement – We may disclose Personal Data to a third party where we are legally required to do so in order to comply with our legal or tax obligations and to comply with any applicable laws, regulations, legal process, subpoenas, court orders, or any governmental requests. We may also share the Personal Data to protect and defend against our or other legal claims and to protect the safety of others.

8. Cross-Border Data Transfers

Our Services are operated in Thailand. We may cross-border transfer your Personal Data as necessary for the purposes described above. If you are not residing in Thailand, your Personal Data will be transferred to and managed in Thailand, where our server is located, in order to provide you with the Services and/or to perform any requested transactions. You acknowledge that data protection and other applicable laws of a foreign jurisdiction (such as Thailand) may not have the same data protection laws in your jurisdiction.

From time to time, we may work with our group companies or third-party service providers and partners in other jurisdictions when providing the Services. This means we may be required to disclose, transfer or otherwise Process your Personal Data outside of Thailand, in order to carry out the purpose of providing Services to you. When we transfer your Personal Data to recipients in other jurisdictions, we will protect the Personal Data as described in this Privacy Policy and will ensure that the Personal Data disclosed or transferred or otherwise Processed has been protected by adequate Personal Data protection measures in accordance with international standards. If necessary, we may request your consent where consent to cross-border transfer is required under applicable laws.

9. Data Security

The Company is committed to maintaining the appropriate technical, organizational, and administrative security measures to protect the security, confidentiality and integrity of Personal Data, and we have put in place data security and access policies to limit access to our systems and technology. However, please be aware that security risk is inherent in internet and information technologies, and we cannot guarantee that any information (including the Personal Data), during transmission or while stored on our systems, will be absolutely safe from intrusion by others.

10. Data Retention

We will retain your Personal Data (a) for the duration of your relationship with us; and/or (b) as long as necessary to carry out the purposes described above; and/or (c) to comply with applicable legal requirements. When it is no longer necessary to Process your Personal Data, we will either delete or anonymize it. Please note that our retention period may be extended if we are required to preserve your Personal Data in connection with any legal proceedings or if a longer retention period is required or permitted by applicable laws.

Subject to the provisions of the Data Protection Laws, you may have a number of rights regarding the Processing of your Personal Data, including:

  1. Right to access: you have the right to access and request a copy of your Personal Data or request disclosure of the acquisition of Personal Data without your consent (we have the right to charge a reasonable fee to complete this request where permitted by the Data Protection Laws).
  2. Right to rectify: you have the right to request your Personal Data to be rectified to be accurate, up-to-date, complete, and not misleading.
  3. Right to request for deletion: you can ask us to delete or destroy or anonymize your Personal Data if it is no longer needed for the purposes set out in this Privacy Policy or if there is no longer a legal basis for the Processing.
  4. Right to object: you can object to the use of your Personal Data for direct marketing (including related profiling) or other Processing based on legitimate interests.
  5. Right to data portability:  in some cases, you can request us to provide a copy of your Personal Data in a format readable or commonly used by automatic tools or equipment, including the right to request the Personal Data in such form to be sent or transferred to another Data Controller (as defined in the Data Protection Laws) by automated means and the right to obtain Personal Data sent or transferred directly to another Data Controller unless it is technically not feasible.
  6. Right to restrict the use of Personal Data: you can limit how we use your Personal Data in certain circumstances.
  7. Right to withdraw consent: you have the right to withdraw your consent you have given for the Processing of Personal Data at any time; the withdrawal can be done by reaching out to the specified contact in this Privacy Policy. Please note that the withdrawal of consent will not affect the lawfulness of the Processing of your Personal Data and Sensitive Personal Data based on your consent before it was withdrawn. If you do not provide consent or withdraw your consent, we may not be able to provide certain or all of our Services to you.

Right to lodge a complaint: you can complain to a data protection authority or the competent authority where you believe our Processing of your Personal Data is unlawful or non-compliant with the Data Protection Laws. Except as otherwise prescribed by law, in the event of any discrepancy or inconsistency between the English version and the local language version of this Privacy Policy, the English version shall prevail.
